Terms of Service

You must provide accurate account information and keep your password secure. You are responsible for all activity that occurs under your account.

Each account is a separate workspace. Your uploaded videos and your contact list are visible only to you and to the Platform owner, as described in these Terms and in the Privacy Policy.

You retain ownership of the videos, images, audio, text and other media you upload ("User Content"). You represent and warrant that you own or have all rights necessary to upload and to grant the licence described below.

By uploading any video, image, or media to NanaTaggedYou, you grant NanaTaggedYou a perpetual, worldwide, royalty-free, irrevocable, sublicensable and transferable licence to use, host, store, reproduce, modify, adapt, edit, publish, display, perform, distribute, and repurpose that content, in whole or in part, for any Platform purpose. Platform purposes include but are not limited to operating and improving the Platform, promotion and marketing of the Platform, editorial and showcase use, and distribution across any channel or media, now known or later developed.

This licence survives the deletion of your content or the termination of your account to the extent that the content has already been incorporated into promotional, editorial or distributed material.

You waive any right to inspect or approve any material that incorporates your User Content, and you waive any claim to compensation, royalties or credit arising from the use described above.

You agree to use the Platform lawfully and respectfully. You will not use the Platform to harass, defame, impersonate, threaten, defraud or infringe the rights of any person.

You will not attempt to gain unauthorised access to any account, system or data; you will not scrape, reverse engineer, overload or interfere with the Platform; and you will not use the Platform to distribute malware or unsolicited bulk messages.

You will not upload content you do not have the rights to, including music, footage or likenesses owned by others without permission.

Illegal or harmful content is strictly prohibited. This includes, without limitation: content depicting or promoting child sexual abuse; non-consensual sexual content; incitement to violence, terrorism or self-harm; hate speech targeting protected characteristics; content that facilitates criminal activity; and content that infringes intellectual property or privacy rights.

Prohibited content may be removed without notice and may be reported to law enforcement where required by law.

The Platform owner may, at any time and at their sole discretion, with or without notice and with or without cause, remove, edit, restrict or refuse to display any content, and may suspend, restrict or terminate any account.

The Platform owner has no obligation to monitor content but may do so. A decision not to act on one item is not a waiver of the right to act on any other.

The Platform owner (administrator) has full access to all accounts, all uploaded media, all contact lists and all activity on the Platform. By using the Platform you acknowledge and accept this level of access.

The Platform uses third-party services to process and deliver media, generate captions and edit suggestions, and send email. Your content and related data may be transmitted to and processed by those providers in order to deliver these features.

One-tap share links open third-party platforms such as TikTok, Instagram, YouTube, Facebook and X. Your use of those platforms is governed by their own terms, not these Terms.

Captions, cut suggestions, hashtags and other AI-generated output are provided as suggestions only. They may be inaccurate or unsuitable. You are solely responsible for reviewing anything you publish.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.

To the maximum extent permitted by law, the Platform owner is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of content, data, revenue, profits or goodwill.

You are responsible for keeping your own backup copies of any media you value. The Platform is not a storage or archival service.

These Terms may be updated from time to time. Continued use of the Platform after an update constitutes acceptance of the revised Terms.

You may stop using the Platform at any time. Sections that by their nature should survive termination — including the content licence in Section 2 — continue to apply.
